Frequently Asked Questions
- How do I know which visa is right for me?
Choosing the correct visa depends on your situation – whether you are working, studying or reuniting with family. Contact us and we will guide you to the best option.
- Do all work related visa lead to settlement?
Not all work-related visa lead to settlement (indefinite leave to remain or ILR) in the UK. The eligibility for settlement depends on the type of visa and whether it allows for a long term stay and eventually transition to permanent residency.
Work visa that can lead to settlement (ILR):
- Skilled Worker Visa (formerly Tier 2 General Visa)
- Global Talent Visa
- Innovator Founder Visa
- Tier 2 Minister of Religion Visa
- Tier 2 Sportsperson Visa
Work visa that do not lead to settlement (ILR):
- Temporary Worker Visas (Tier 5)
- Graduate Visa
- Expansion Worker visa under the Global Mobility Route
- Permitted Paid Engagement visa
Even if your current visa does not lead directly to settlement, many UK work visas allows you to switch to a different category that does provide a path to ILR. Generally, after accumulating 5 years of lawful residence in the UK under qualifying visas, you may be eligible for settlement (ILR).
If you need help determining whether your visa leads to settlement or how to switch to a settlement – eligible visa, we can assit you with advice and the application process. Call our lawyers on 0333 034 8887 or request a call back.
- Who can work in the UK without a visa?
Some people can work in the UK without a visa, including:
- Settled workers
- EU nationals who entered the UK before December 31, 2020
- Family Visa holders
- Global Talent Visa holders
- International students on Student Visas
- Graduate Visa holders
- Holders of visas under the Global Mobility Route
- Ancestry Visas holders
- How can I employ workers who are overseas?
You will need a sponsor licence. A sponsor licence allows business to hire foreign nationals legal by sponsoring their work visas. It is a legal requirement for any company looking to employ non-citizens and migrants who do not have automatic right to work in the UK.
- What type of sponsor licence does my company need?
Employees may require a Certificate of Sponsorship issued under Tier 2 Skilled Worker route or Tier 5 Temporary Work route. Charities and Educational institutions can also apply for sponsor licence if they wish to employ workers from overseas or UK graduates. If you and your business are overseas we will advise you about the options you may have to sponsor workers under the Global Business Mobility route.
- Can an overseas business obtain a sponsor licence?
A business based overseas cannot directly obtain a UK sponsor licence unless it has created a footprint, or established presence in the UK. We can assist your business with establishing a UK branch or subsidiary. Once established, the UK entity can apply for sponsorship licence to sponsor workers under the UK visa system.
- What are the requirements for obtaining a sponsor licence?
- Prove that it is a legitimate, operating business
- Demonstrate a genuine need to hire foreign workers
- Have the necessary HR systems in place to monitor and report on sponsored employees
- Meet any specific industry compliance standards.
We will ensure that you meet these requirements and guide you through the application process.
- How do I apply for a sponsor licence ?
The process typically involves:
- Completing an online application
- Submitting documentation that proves your business’ eligibility such as financial records, business registration documents, employer liability insurance etc.
- Paying the relevant application fee and potentially priority service fee. As the Home Office is inclined to change the immigration applications fees annually, we will advise you about the current fees before we start the application process.
Once submitted, immigration authorities may conduct an inspection of your business to verify your compliance. We can prepare you for such inspection by carrying out a mock audit prior to the visit by the Home Office.
- What are the compliance requirements for businesses hiring foreign workers?
Employers must comply with a range of immigration laws, including:
- Keeping records for all sponsored employees. We will advise what documents and information must be retained and for how long.
- Reporting significant changes in employment such as role changes or termination of employment
- Ensuring that the employees have the right to work in the country and regularly checking visa status.
- Issuing a Certificate of Sponsorship which contains the relevant information which is compliant with the Skilled Worker Visa requirements.
- Maintaining the Sponsorship Management System and managing the sponsored workers in line with the Home Office guidance and requirements.
Non-compliance can result in fines, sanctions, or loss of sponsorship licence.
- How long does the immigration process take?
Time spent in preparation of immigration applications may vary by visa type and complexity, but we work diligently to expedite your case as much as possible.
