The cross-border probate team at IMD Solicitors recently assisted in a matter that demonstrated the challenges that arise when a deceased individual had ties to both the UK and another jurisdiction.
In this case, the deceased passed away in Greece, where they were domiciled and where their estate was being administered. However, the personal representatives also needed to pursue a claim under the UK Infected Blood Compensation Scheme. The deceased had previously been registered with one of the UK’s Infected Blood Support Schemes. This meant the estate could access an interim compensation payment, provided the appropriate UK-recognised probate documentation was supplied.
Navigating the Documentation Requirements
The case was handled by cross-border probate associate solicitor Rezwana Dithy, who managed the legal strategy and international coordination required for the claim. Rezwana ensured that the Greek estate documentation was presented in a form that met the UK scheme’s requirements—an essential step in securing the compensation for the estate.
Because the estate was handled entirely under Greek procedures, the personal representatives did not initially hold the type of UK-style probate documentation typically required. IMD Solicitors coordinated the necessary formalities, certifications, and translations to ensure the documents satisfied UK evidential standards.
Successful Outcome
With the documentation aligned to UK requirements, the personal representatives were able to proceed with the application in order to successfully receive the interim compensation payment on behalf of the estate.
Why This Case Matters
This matter highlights a recurring issue in cross-border estates: UK-based claims often require specific probate documentation that foreign legal systems may not automatically produce. Without specialist assistance, personal representatives can struggle to access compensation or rights linked to the UK.
IMD Solicitors’ cross-border probate team regularly bridges this gap, working with overseas professionals where appropriate, to ensure foreign-issued documents are accepted in the UK. This enables personal representatives to secure entitlements and compensation that might otherwise be difficult to obtain.
For support with international probate, multi-jurisdictional estates, or UK claims involving a deceased person domiciled overseas, IMD Solicitors are here to assist.
